Terms of Service

These Terms of Service ("Terms") govern your access to and use of thetimeowner.com (the "Service"), operated by Hungry Passport Media, Inc., with offices at 4225 Solano Ave., Ste. 631, Napa, CA 94558, United States ("we," "us," "our"). By using the Service, joining the waitlist, reserving a date, claiming a day, or purchasing any upgrade, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (16 in the EEA) to use the Service. By using the Service you represent that you have the legal capacity to enter into this agreement and that all information you submit is accurate.

2. What ownership means

Claiming a day on The Time Owner is a formal declaration of association, within this registry, between a name you provide and a calendar date. It is not a legal property right in the date itself, in any historical event that occurred on that date, or in the use of that date by any other person or entity. The Service does not confer any trademark, copyright, or other intellectual property right in a date.

3. Pre-launch reservations and invitations

While the Service is in pre-launch, public claims are not yet open. There are two paths during this phase:

  • Specific-date reservations are by invitation only. A reservation for a specific calendar date requires a valid invitation code held by an existing reserver. Holders of a successful reservation each receive three single-use invitation codes to share. We do not sell or assign invitations directly.
  • The general waitlist is open to anyone. Joining the waitlist requires only an email address and grants first access when public claims open at launch.

Reservations and waitlist signups:

  • Are non-binding holds. They do not constitute a purchase, contract, or guarantee that a claim will be available, granted, or honored.
  • Require no payment at the time of reservation.
  • Will be honored, where reasonable, at the price announced at launch for the date's tier (Standard, Notable, or Landmark). Pricing shown during pre-launch (for example, "from $29") is indicative and reflects the floor of each tier; final pricing is announced at launch.
  • May be declined or withdrawn by us, at our discretion, if a date is reclassified as historically blocked, if abuse is detected, if required by law, or if the Service is paused, modified, or closed. Where we decline a reservation, we will use reasonable efforts to notify you and offer the waitlist or an alternative.
  • May be withdrawn by you at any time by replying to any of our emails or contacting us.
  • Expire if you do not convert your reservation to a claim within 30 days of the announced launch date, or such longer period as we communicate.

Nothing in this section creates an obligation on our part to deliver any specific date, name, or feature, or to honor a reservation whose holder we determine in good faith should be denied for the reasons listed above.

4. Claims (when the registry opens)

A claim is a permanent public registry entry. Once made, the owner name and date are part of the permanent record. You may update or remove your bio, photograph, and website. The name and date are not transferable.

You may claim multiple distinct dates. Each claim is independent.

5. Acceptable use and prohibited content

You agree not to use the Service to submit content that:

  • Is unlawful, infringing, defamatory, harassing, threatening, or abusive.
  • Promotes hatred or violence against any group based on protected characteristics.
  • Contains sexually explicit material, content depicting minors in any sexual or suggestive way, or content that exploits any person.
  • Reveals private information of third parties without authorization.
  • Impersonates another person or misrepresents your affiliation.
  • Is used to send spam, phishing, or commercial solicitations to other users.
  • Violates any applicable law or these Terms.

You may not interfere with the Service, attempt unauthorized access, scrape data at scale, or circumvent rate limits or security measures.

We may, in our sole discretion, refuse, remove, or modify any submission that violates these Terms, with or without notice, and without refund.

6. Reserved and blocked dates

We reserve a small set of dates of broad historical sensitivity from being claimed (for example, dates associated with major tragedies). These dates are clearly marked and reservations against them will not be honored. We may also reclassify dates from time to time. In the rare event that a date you reserved is later blocked, we will notify you and offer an alternative or refund any payment.

7. Payments and refunds

Once paid claims and upgrades are open, payments are processed by Stripe. Prices are listed at the time of purchase. By submitting payment you authorize us to charge the listed amount.

Because a claim is a permanent registry entry that we begin fulfilling immediately upon payment, all sales are final and non-refundable except (a) where required by law, (b) where the date you paid for has been blocked, or (c) at our discretion. Printed certificates and other physical goods may be refunded if unfulfilled and unshipped.

8. Email communications

By joining the waitlist or making a reservation, you consent to receive launch updates and reservation-related email from us. You can unsubscribe at any time using the link in any email or by contacting us. Transactional messages (payment receipts, claim confirmations) are sent regardless of marketing preferences.

9. Intellectual property

The Service, including its visual design, code, and original copy, is owned by us and protected by copyright and other laws. You retain ownership of the content you submit to your record (bio, photograph). By submitting, you grant us a worldwide, royalty-free, non-exclusive license to host, display, and reproduce that content as needed to operate the registry.

If you believe content on the Service infringes your rights, send a notice to [email protected] with: identification of the work, identification of the infringing material, your contact details, a good-faith statement, and a statement under penalty of perjury that you are authorized to act.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we are required to by law. Provisions that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, dispute resolution) will survive.

11. Service availability and changes

We aim to maintain the Service indefinitely, but we do not guarantee uninterrupted availability. We may modify or discontinue features at any time. If we discontinue the registry as a whole, we will give record holders at least 90 days' notice and an opportunity to export their entries.

12. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and availability. To the extent permitted by law, we disclaim all such warranties.

13. Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to the Service. Our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) US$50.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to that jurisdiction. Where local consumer law gives you stronger rights, those rights still apply.

15. Changes to these Terms

We may update these Terms. Material changes will be reflected by updating the "Last updated" date and, where appropriate, by notifying you by email. If you do not agree to a change, stop using the Service. Continued use after the change constitutes acceptance.

16. Entire agreement; severability

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remaining provisions remain in full force.
